1. About these Terms

This website, https://www.luckyyogurt.ph, and the Lucky Yogurt brand are owned and operated by Fortune Crest Trading Corporation, a corporation duly registered with the Philippine Securities and Exchange Commission under Registration No. 2026030242450-03, with Taxpayer Identification Number 699-316-810-00000 and principal place of business at 1102 Davides St., Binondo, Manila 1006, Philippines.

In these Terms, “we”, “us”, “our” and “the Company” mean Fortune Crest Trading Corporation. “You” and “Customer” mean the person browsing this website or placing an order through it.

By browsing this website, placing an order, or paying for an order, you agree to be bound by these Terms together with our Privacy Policy, Cancellation Policy, and Refund Policy, which form part of these Terms. If you do not agree, please do not use this website.

2. Eligibility

You must be at least 18 years old, or be using the website under the supervision of a parent or legal guardian, to place a paid order. By placing an order you confirm that the information you give us is accurate and that you are authorised to use the payment method presented.

3. Products and availability

• All products are freshly prepared food and beverage items sold for immediate consumption.
• Product photographs and illustrations on this website are representations. Actual servings may differ in appearance.
• Menu items are subject to availability. If an item you paid for is unavailable, we will contact you to offer a substitution or a refund of that item under our Refund Policy.
• Certain items are marked dine-in only and cannot be ordered for pickup or delivery because they do not travel well.

Allergens

Our products contain or may come into contact with dairy, nuts, soy, gluten and other allergens. We prepare all items in a shared kitchen and cannot guarantee an allergen-free product. If you have a food allergy or intolerance, please tell us before ordering and use the order notes field.

4. Prices and taxes

All prices are shown in Philippine Pesos (₱) and are VAT-inclusive where applicable. Prices may change without prior notice, but the price shown at the time you confirm your order is the price that applies to that order. An official receipt is issued for every completed transaction in accordance with Bureau of Internal Revenue requirements.

5. Placing an order

1. Build your cart from the online menu.
2. Enter your name, mobile number, email address and preferred pickup time at checkout.
3. Pay online through our payment provider. You are redirected to the provider’s secure page to complete payment.
4. On successful payment you receive an order reference on screen and by email. Present it at the store counter to collect your order.

6. Payment

Online payments are processed by Xendit, a payment service provider regulated by the Bangko Sentral ng Pilipinas, and by Asia United Bank (AUB). You may pay by GCash, Maya, GrabPay, credit or debit card, online banking, QR Ph (any participating bank or e-wallet app), WeChat Pay or Alipay; which methods are offered, and which provider processes each, depends on availability. Card and wallet credentials are entered on the provider’s systems and are never collected or stored by us. We receive only the transaction result and a masked reference.

You may also choose to pay in store, and we list third-party delivery partners such as foodpanda and GrabFood. Orders placed through a third-party platform are governed by that platform’s own terms, not these Terms.

7. Collection and fulfilment

Paid online orders are prepared for pickup at 1102 Davides St., Binondo, Manila 1006, Philippines at the time slot you selected. Please arrive within your slot — because our items are freshly made, quality degrades quickly. Orders not collected by the end of our operating day are treated as a no-show and are governed by our Cancellation Policy.

8. Group orders

Our group-order feature lets one host share a link so that several people can add items to a single shared cart. The host is responsible for the contents and payment of the combined order. Anyone holding the group-order link can view and add to that cart until the host locks it, so share the link only with people you intend to order with.

9. Acceptable use

You agree not to:

• place fraudulent, abusive or speculative orders;
• interfere with, probe or attempt to gain unauthorised access to the website or its underlying systems;
• use automated means to scrape, overload or disrupt the website; or
• copy, reproduce or republish our content, branding or imagery without our written permission.

10. Intellectual property

All content on this website — including the Lucky Yogurt and 幸耐小罐酸奶 names and logos, text, photography, illustrations, and the design and code of the site — is owned by Fortune Crest Trading Corporation or its licensors and is protected by Philippine and international intellectual property law.

11. Limitation of liability

To the fullest extent permitted by Philippine law, our total liability arising out of or in connection with an order is limited to the amount you actually paid for that order. We are not liable for indirect or consequential loss. Nothing in these Terms limits any liability that cannot lawfully be limited, including your statutory rights as a consumer under Republic Act No. 7394 (the Consumer Act of the Philippines).

12. Availability of the website

We aim to keep the website available at all times but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the site for business or operational reasons.

13. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the moment you place an order is the version that governs that order. The effective date is shown at the top of this page.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be brought before the proper courts of the City of Manila, without prejudice to your right to seek redress through the Department of Trade and Industry or other competent consumer authority.
